Cancelling Home Insurance in Luxembourg: Deadlines, Grounds and Steps 2026

In Luxembourg, you can cancel your home insurance policy at the annual renewal date with a minimum notice period of 30 days, or on legitimate grounds — moving abroad, an unexpected premium increase, cancellation following a claim, or the sale of the insured property. Unlike in France, there is no equivalent of the Loi Hamon allowing free cancellation after one year. Here is everything you need to know to cancel your policy correctly.

The cancellation of a home insurance contract in Luxembourg is governed by the Law of 27 July 1997 on the insurance contract, which has been amended several times since. Three articles are particularly relevant to cancellation: Article 38 (cancellation at renewal), Article 39 (notification requirements) and Article 42 (cancellation following a premium change).

Unlike France or Belgium, Luxembourg has not adopted an equivalent of the Loi Hamon. You cannot therefore freely cancel your policy after one year. Cancellation is only possible at the annual renewal date or on legitimate grounds as defined by law.

Key point: The minimum statutory notice period is 30 days before the renewal date. Always check your general conditions: some contracts may provide for different notice periods depending on the chosen method of notification.

The law also requires insurers to remind policyholders of their annual cancellation right and the renewal date in every contract. Contracts are annual with automatic renewal: if not cancelled in the required manner, the contract automatically extends for a further year.

The 5 permitted grounds for cancellation

Luxembourg law recognises five situations in which you may cancel your home insurance — at renewal or outside the usual framework.

1

Cancellation at annual renewal

The most common scenario. You may cancel every year at the renewal date of your contract. Notice required: 30 days before the renewal date. Legal basis: Article 38 of the Law of 27 July 1997.

2

Moving abroad from Luxembourg

If you leave the Grand Duchy to settle in another country, the insured risk disappears. You are entitled to automatic cancellation by operation of law. Important: moving within Luxembourg does not constitute grounds for automatic cancellation (unlike in France).

3

Premium increase not provided for in the contract

If your insurer raises your premium beyond the contractually agreed indexation, you have the right to cancel. Deadline: 60 days from the date the renewal notice is sent showing the increase. Legal basis: Article 42 of the Law of 27 July 1997.

4

Cancellation by the insurer following a claim

If your insurer cancels one of your covers or policies following a claim, you may cancel your other contracts with that same insurer. Deadline: within one month of notification of cancellation by the insurer.

5

Sale or transfer of the insured property

When the insured property is sold, the contract ends automatically. Cancellation takes effect by operation of law 3 months after the date of the notarial deed of sale. During this period, the buyer may choose to take over the contract in their name. Legal basis: Article 69 of the Law of 27 July 1997.

Moving within Luxembourg (from Luxembourg City to Esch-sur-Alzette, for example) is not a valid ground for cancellation. You will need to either transfer your policy to the new property or wait until the annual renewal date to switch insurer.

Cancelling at annual renewal

Cancelling at renewal is by far the most common scenario. It allows you to switch insurer every year to benefit from better cover or a better price-to-value ratio. According to our Switchr comparison tool, differences between insurers can be significant for the same level of cover.

Article 38 of the Law of 27 July 1997 provides that any policyholder may cancel their contract each year at the annual premium renewal date — or failing that, at the anniversary of the contract’s start date. This right must be stated in every contract.

Most Luxembourg insurers send a renewal notice before the contract is extended. This notice states the deadline for cancellation. Some general conditions also allow cancellation within 30 days of receiving this notice — check the exact terms in your contract.

Typical timeline for cancellation at renewal

Cancelling when moving

Moving home is a special case under Luxembourg law. Unlike France, where any move allows you to cancel, in Luxembourg only moving abroad from the Grand Duchy triggers automatic cancellation.

Moving abroad: automatic cancellation by law

If you leave Luxembourg to settle in another country, your home insurance ends automatically: the insured risk (your Luxembourg property) no longer exists. There is no statutory notice period, but you must inform your insurer as soon as possible and provide the necessary supporting documents.

Documents typically requested by insurers: a certificate of change of residence issued by your Luxembourg commune, and proof of address in the destination country (rental agreement, title deed, utility bill). Exact requirements vary by insurer — contact them directly to confirm.

Cancellation takes effect from the date the insurer receives the supporting documents. You will receive a pro-rata refund for the unused portion of your premium. For example, if you leave on 15 June and have paid your premium up to 31 December, you will receive a refund for the remaining months.

Moving within Luxembourg: no automatic cancellation

If you move within Luxembourg, you cannot cancel automatically. You have two options: transfer your policy to the new property (your insurer will recalculate your premium based on the new property’s characteristics; if the new rate does not suit you, you will need to wait until the annual renewal date to cancel) or wait until the annual renewal date to cancel if you prefer to switch insurer, giving 30 days’ notice.

If you are a tenant, keep your home insurance active on the old property until you hand back the keys and complete the exit inventory. Always take out your new insurance before cancelling the old one — never leave yourself without cover.

Cancelling following a premium increase

Article 42 of the Law of 27 July 1997 protects policyholders against unilateral premium increases. If your insurer raises your premium beyond the indexation provided for in your contract, you have a specific right to cancel.

Indexation or premium increase: what is the difference?

Annual indexation

  • Provided for in the contract’s general conditions
  • Linked to a price index or construction index
  • Applied automatically each year
  • Does NOT give the right to cancel
VS

Exceptional premium increase

  • Not provided for in the original contract
  • Unilateral decision by the insurer
  • Change in conditions or rates
  • Gives the right to cancel within 60 days

How to tell the difference? Compare the rate of increase applied to your premium with the indexation rate stated in your general conditions. If your premium rises beyond what is contractually provided for — and the insurer does not justify the reason — it is likely an exceptional increase giving you the right to cancel. If in doubt, contact your insurer in writing to ask for an explanation of the increase.

Procedure in the event of a premium increase

The insurer must notify any premium change before it takes effect, generally via the annual renewal notice. From the date that notice is sent, you have 60 days to cancel by registered letter, in accordance with Article 42 of the Law of 27 July 1997.

In your letter, explicitly cite Article 42 of the Law of 27 July 1997 and enclose a copy of the renewal notice showing the increase. Take out your new insurance before the cancellation takes effect to avoid any gap in cover.

Cancellation following a claim

Cancellation following a claim can be initiated by the insurer or the policyholder in certain circumstances. This is a situation that often raises questions.

Can the insurer cancel after a claim?

Yes, but only if this right is expressly provided for in the contract’s general conditions. Luxembourg law allows the insurer to cancel after settling a claim, in accordance with the conditions and deadlines set out in the general conditions — always check the exact terms in your contract.

In practice, Luxembourg insurers rarely cancel after a single isolated claim. Cancellation is most common in cases of repeated claims, major losses, or proven fraud (intentional misrepresentation to obtain compensation).

Your right to cancel if the insurer cancels another contract

If your insurer cancels one of your covers or policies following a claim, you may cancel your other contracts with the same insurer, including your home insurance. This is the « cascade cancellation » mechanism. You must send your letter within one month of the insurer’s cancellation notification.

Situation Who cancels Deadline to act Notice period
Repeated or major claims Insurer After settlement Per general conditions
Cascade cancellation (other policy) Policyholder 1 month after notification 30 days
Proven fraud Insurer Immediate No notice required

Step-by-step cancellation procedure

Whatever your situation, cancelling home insurance in Luxembourg follows a precise process. Here are the 7 steps to follow to ensure a valid cancellation.

1

Check your contract terms

Review your general and specific conditions. Identify the renewal date, the required notice period and the specific cancellation terms in your contract. Note whether you pay annually or monthly — this may affect your refund.

2

Compare alternative offers

Before cancelling, use our home insurance comparison tool to find a better deal. Make sure the new policy covers at least the same guarantees as your current contract.

3

Take out your new insurance first

Take out your new policy with a start date matching the end of your current contract. Request a certificate of insurance — your landlord may ask for one if you are a tenant. Never cancel before you have a new contract in hand.

4

Write your cancellation letter

Your letter must include: your full contact details, the policy number to be cancelled, the renewal date, the grounds for cancellation and the applicable article of law (Art. 38, 42 or 69 depending on your situation), and a request for written confirmation. Be factual and concise.

5

Send by recorded delivery with acknowledgement of receipt

In accordance with Article 39 of the Law, cancellation must be notified by registered post, by bailiff’s process server, or by hand delivery against receipt. A simple email has no legal force. Address the letter to the insurer’s registered office, not to your local agent.

6

Keep proof of sending

Keep the postal acknowledgement of receipt and a copy of your letter in a safe place. These documents serve as your evidence in the event of a dispute. The date of receipt by the insurer is what counts for compliance with the notice period.

7

Check confirmation and refund

Your insurer must send you written confirmation of cancellation. If you paid your annual premium in advance, you will receive a pro-rata refund for the unused period. Check that the amount matches the expected proportional calculation.

Re: Cancellation of home insurance policy no. [Policy number]
Registered letter with acknowledgement of receipt

Dear Sir or Madam,

I, the undersigned [First and Last Name], holder of home insurance policy no. [Policy number], hereby give notice of my decision to cancel the said policy at its next renewal date, in accordance with Article 38 of the Law of 27 July 1997 on the insurance contract.

The renewal date of my policy being [Renewal date], please note that this cancellation will take effect on that date.

I would be grateful if you could confirm in writing that this cancellation has been duly recorded and, where applicable, refund the premium corresponding to the unused period of insurance cover.

Yours faithfully,

[Signature]

The 7 mistakes to avoid

Cancellation may seem straightforward, but many policyholders make mistakes that invalidate their request or leave them without cover. Here are the most common pitfalls.

1

Sending the letter too late

If your registered letter is received by the insurer fewer than 30 days before the renewal date, the cancellation will be refused and the contract will be automatically extended for a year. Allow a buffer of 35 to 40 days to be certain the letter arrives in time.

2

Sending to the local agent rather than the registered office

Cancellation must be addressed to the insurer’s registered office, not to your local agent. The address appears in your general conditions and on the website of the Commissariat aux Assurances (CAA). Sending to the agent can extend processing times and jeopardise the notice period.

3

Being left without cover

Cancelling without having taken out a new policy is extremely risky. In the event of a claim during the uninsured period, you must cover all costs yourself. For a tenant, the absence of insurance also constitutes a breach of the lease. ALWAYS take out your new insurance BEFORE cancelling the old one.

4

Confusing indexation with a premium increase

Annual indexation — a contractually provided adjustment linked to an index — does not give you the right to cancel. Only an unexpected premium increase not provided for in the contract entitles you to cancel within 60 days of the renewal notice being sent showing the increase (Art. 42). Read your general conditions carefully before invoking this right.

5

Using a standard letter or email

Only a registered letter with acknowledgement of receipt, a bailiff’s process server, or hand delivery against receipt has legal force for a cancellation (Art. 39). An email or ordinary letter offers no legal protection. Even if your insurer usually communicates by email, cancellation requires registered post.

6

Assuming you can cancel freely after 1 year

The French Loi Hamon does not apply in Luxembourg. You can only cancel at the annual renewal date or on legitimate grounds as defined by law. This is a common misconception among cross-border workers or expatriates from France.

7

Not checking your specific contract terms

Some contracts include specific provisions (different deadlines depending on the notification method, special conditions for optional covers, etc.). Read your general and specific conditions before acting. If in doubt, call your insurer to confirm.

Insurer-specific details

All Luxembourg insurers are subject to the same law, but their general conditions may provide for slightly different terms. Here is what the official documents of the 4 main CAA-approved insurers for home insurance in Luxembourg specify.

LALUX Assurances — easyPROTECT Home

According to LALUX’s product information document (IPID), the easyPROTECT Home policy can be cancelled by registered letter 30 days before the annual renewal date. Cancellation is also possible within one month of the insurer cancelling a cover or another policy following a claim, or within 60 days of a premium increase notified by the insurer.

Notable point: in the event of moving abroad from the Grand Duchy of Luxembourg, LALUX expressly states that there is no automatic renewal of the contract. LALUX offers three home insurance plans: Sécurité, Confort and Performance, with a range of additional options and packs.

Foyer Assurances

According to Foyer Assurances’ general conditions, you can cancel your home insurance policy by registered letter, bailiff’s process server or hand delivery against acknowledgement of receipt, either within 30 days of the date the insurer sends the renewal notice, or 30 days before the annual premium renewal date.

Foyer also states that cancellation is possible if the insurer modifies the insurance conditions, applies a premium increase, or cancels one or more covers — subject to the deadlines set out in the contractual documents. Foyer Assurances offers a modular home insurance range suited to both tenants and homeowners.

AXA Luxembourg — OptiHome

According to AXA Luxembourg’s IPID, the OptiHome policy must be cancelled with at least 30 days’ notice before the annual premium renewal date (or failing that, 30 days before the anniversary date), by registered letter, bailiff’s process server or hand delivery against receipt.

AXA Luxembourg is located at 1, place de l’Étoile, L-1479 Luxembourg. For any cancellation, address your letter to the registered office, not to your local branch. AXA offers the OptiHome product for flats and houses, with optional covers (personal liability, legal protection, travel insurance, etc.).

Baloise Luxembourg — Home

According to Baloise Luxembourg’s IPID, the Home policy must be cancelled by registered post, by bailiff’s process server or by hand delivery against receipt, in the cases and within the deadlines provided for by the Law of 27 July 1997 and set out in the specific or general conditions.

Baloise offers two home insurance plans: Essentielle and Intégrale. The Essentielle plan covers core guarantees (fire, weather events including flooding, water damage, glass breakage, electrical damage, property liability, assistance). The Intégrale plan additionally covers theft, new-for-old replacement, and multimedia and valuables packs.

Frequently asked questions about cancellation

Can I cancel my home insurance at any time in Luxembourg?

No. In Luxembourg, there is no equivalent of the French Loi Hamon allowing free cancellation after one year. You can only cancel at the annual renewal date (with a minimum of 30 days’ notice), or on legitimate grounds: moving abroad from Luxembourg, an unexpected premium increase not provided for in the contract, cascade cancellation following a claim, or the sale of the insured property.

What is the statutory notice period for cancellation?

The minimum statutory period is 30 days before the annual renewal date of the contract, under Article 38 of the Law of 27 July 1997. This deadline applies to the insurer’s receipt of the letter — not the date of sending. You should therefore send your registered letter at least 35 to 40 days before the renewal date. Some contracts may provide for different terms: check your general conditions.

Can I cancel if I move within Luxembourg?

No. Moving within the Grand Duchy is not a valid ground for automatic cancellation. You will need to either transfer your policy to the new property (your insurer will recalculate your premium) or wait until the next annual renewal date to cancel. Only moving abroad from Luxembourg results in automatic termination of the contract.

How do I tell the difference between a cancellation-triggering increase and simple indexation?

Annual indexation is provided for contractually (linked to a price or construction index) and does not give the right to cancel. By contrast, a unilateral premium increase not provided for in the contract entitles you to cancel within 60 days of the renewal notice being sent showing the increase (Art. 42). Compare the rate of increase applied to your premium with the indexation rate stated in your general conditions. If in doubt, contact your insurer in writing for an explanation of the increase.

Can I cancel by email?

No. Legally, cancellation must be notified by registered post, by bailiff’s process server, or by hand delivery against receipt, in accordance with Article 39 of the 1997 Law. A simple email has no legal force for a cancellation, even if your insurer accepts it for other matters. Always use a registered letter with acknowledgement of receipt.

Who should I address my cancellation letter to?

The letter must be addressed to the insurer’s registered office, not to your local agent. The registered office address appears in your general conditions, on your renewal notice, and on the website of the Commissariat aux Assurances (CAA). Sending to the agent can extend processing times and jeopardise the 30-day notice period.

What happens if I cancel without new insurance in place?

This is a very risky situation. In the event of a claim (fire, water damage, theft) during the uninsured period, you must cover the full cost from your own funds. For a tenant, the absence of insurance also constitutes a breach of the lease, which may result in contractual penalties. Always take out your new insurance before cancelling the old one.

Will I receive a refund if I paid my annual premium in advance?

Yes. Luxembourg law provides for a pro-rata refund of the premium for the unused period of insurance cover. For example, if you cancel on 30 June and have paid until 31 December, you will receive a refund for the remaining 6 months. Check the amount on the statement sent by your insurer.

Can my insurer refuse my cancellation?

No, provided you comply with the legal requirements: 30 days’ notice, notification by registered letter, and a valid ground. If your insurer refuses without valid reason, you can contact the Commissariat aux Assurances (CAA) or the Union Luxembourgeoise des Consommateurs (ULC). However, if the notice period is not respected, the insurer can legitimately refuse and the contract will be automatically renewed.

How long after a claim can the insurer cancel my policy?

The insurer can cancel after settling a claim only if this right is provided for in the general conditions. The terms and deadlines for cancellation by the insurer are set by your contract’s general conditions — check them carefully. In practice, Luxembourg insurers rarely cancel after a single isolated claim — cancellation mainly concerns repeated claims or proven fraud.
